I am in full support of the LGBTQ community in our great state of Texas. Acceptance has been improving in our state, but there needs to be more done to protect our Texans from employment discrimination in private, retail, food service and big corporations. It would benefit the state by providing protection to the LGBTQ community because they will be productive leaders and supports economically to our communities. Also, with these laws in place not only will protect the LGBTQ community but will also deter crime against people of different sexual orientation and gender identity.
Fear of being decimated upon many at the workplace hide their sexual orientation or gender identity to their employers.
It is such a negative impact to the LGBTQ community not being able to find or keep employment because they are open about their gender identity. Discrimination at a workplace can also affect a person by creating a hostile environment for them by the stigma or prejudice of exposure by other in the workforce.
It can cause or worsen issues in their mental health such as anxiety, depression or even suicidal thoughts. Some local and state government have concluded that the LGBTQ community face widespread discrimination in their place of employment. There is currently no protection by the Federal Government to protect them, there are amendments in place by the state and local government to protect them, but more is needed.
Since 1994 the Employment Non-Discrimination Act has made some changes in state and local levels to protect the LGBTQ communities against employment discrimination.
In fact, in 2019 there was a change on done in the Civil Rights Act by the United States House of Representatives to prohibit discrimination based on sex, sexual orientation, gender identity or pregnancy. There is no current pending legislation to protect the LGBTQ community, but at local level implemented laws are pending to protect and support them. There needs to be changes done to our legislature in the federal level and make this injustice a federal crime if broken. I believe our federal government needs to catch up with the times with the LGBTQ community and make an effort to fix current issues in and state and local level and update laws to match new a new society.
There have been some cases in the United States where the injustices come to light in a federal court and in public eyes. These cases have improved and made changes in our government on discrimination the workplace, such case as Altitude Express Inc. Vs Zarda. Mr. Don Zarda worked in a skydiving business in Long Island, New York, he was terminated from his position because of his sexual orientation. Mr. Zarda stud up for himself and sued the company that discriminated on him and won the law sue because of Title VII of the Civil Rights Act of 1964 of the U.S. Equal Employment Opportunity Commission which states, “an employer many not discriminate with regard to any term, condition, or privilege of employment”. Another case that made changes in the State of Colorado and the state adopting an Amendment to their state Constitution was Romer vs. Evans, this case protected the rights of homosexuals and as of 1995 they have the right of parade organization and not to be excluded because of their gender identification.
There are many ways to update and fix society, and it will take time, but by education the older communities that are stuck in their ways of not taking or communicating with each other. Educating communities and religious groups that being part of the LGBTQ is not evil or it should not be frowned upon. We should be mindful, support and protect the safety of the LGBTQ community. There are many ways to support them by creating protected and safe places such as gender neutral toilets in public areas and be vocal with the once that do not respect them by contacting our local and state representatives to make changes for a positive change.
The support and education currently must start at the top of our federal government, at the federal level, it should start with the White House. Our current United States President at first did support and promised the LGBTQ community changes in laws to protect their rights and made many promises that he did not keep. One President Donald Trump was sworn in the took back all the promises. According to NBC news in January 20th 2017 negative changes were made to the White House, State Department and Labor Department websites within 'minutes' of his having been sworn into office, according to GLAAD, a national LGBTQ advocacy group”. President Trump took back promises to protect and support the LGBTQ community and failed to make federal laws and policies or failed to pass laws to protect the LGBTQ community in the future. He just used their vote and the LGBTQ support and did nothing to thank them or even tried to make a change.
There is currently no pending legislation to protect the LGBTQ community, but there needs to be laws in a federal, state, and local level implemented to protect and support them. I believe that it depends on the next elected president in the coming year there will be change. Our president and federal government need to make changes to support the LGBTQ community they our friends, our family, sons and daughters, they are our brothers and sisters and they are a part of our community, they need our support and protection. We need to stand up and unite for them, we must stop this injustice of discrimination because of their choice of sexual orientation and gender identity. As a community we can advocate for the LGBTQ community in our city, our state and in federal level. They don’t need to hide who they are at their place of employment to be able to provide the basic necessities in their lives. They are law abiding American citizens, who pay their taxes every year, and contribute to the economy by being independent and productive citizens. Isn’t that the American dream to be free to be who they want to be.
