Stand Up Constitution
We, the member organization of the Student Alliance for the Advancement of Democratic Rights in UP (STAND UP), imbued with a strong desire to advance student rights and welfare, recognizing the need to unite the studentry and link its struggle with the basic sectors of the society in pursuing for a nationalist, scientific and mass –oriented education, do hereby ordain and promulgate this constitution.
Article IGeneral Provisions
Section 1This alliance of various student organizations and individuals of the University f the Philippines –Diliman founded on February 1996 shall be officially known as STUDENT ALLIANCE FOR THE ADVANCEMENT OF DEMOCRATIC RIGHTS IN UP or STAND – UP. Section 2The STAND – UP shall officially adopt the logo of the Oblation with a red flag its right hand. The Oblation represents the UP students fighting for his/her democratic rights and interests and in service to the people, and the red flag signifies militancy. Section 3The official color of STAND – UP shall be red.
Section 4The STAND – UP shall have the STAND – Update as its official monthly publication. Section 5The STAND – UP shall maintain office at the UP Diliman campus.
Article IIDECLARATION OF PRINCIPLES
Section 1The STAND – UP believes that education is a right. Section 2The STAND – UP believes that the present Philippine educational system is colonial, commercialized and repressive. This educational system is founded upon an agrarian, backward and foreign dominated society. Section 3The STAND – UP believes that there is a need to raise the awareness if the UP studentry and unite them to struggle for a nationalist, scientific and mass-oriented education. Section 4The STAND – UP shall preserve militancy in advancing the democratic rights and welfare of the students. Section 5 The STAND – UP shall integrate its struggle with that of the other sectors, serving not only the studentry but also the rest of the society. Section 6The STAND UP believes that in the practice of building principled unity and consensus.
Section 1Membership in the STAND – UP shall be open to all student formations and individuals in UP Diliman who are committed to the Alliance’s principles and objectives. Section 2The acceptance of organizations and individuals into the Alliance shall be determined the General Assembly upon the recommendation of the Membership Committee. Section 3Any member organization or individual may withdraw its membership at any time provided that an appropriate explanation is presented to the Membership Committee.
Section 4Any member organization or individual may be given sanctions, including expulsion, by the Executive Board with the affirmation of the General Assembly and after a proper observance of sue process on the basis of wilful violation of this Constitution and any form o misconduct which undermines the integrity of the Alliance. Section 5Reaffirmation of membership shall be done annually through the General Assembly. Section 6The STAND – UP shall accept individuals as members provided that they are committed to the Alliance’s principles.
Article IVRIGHTS AND PRIVILEGES OF MEMBERS
Section 1All member organizations shall determine and appoint their two (2) official representatives, i.e. regular and alternative representative, to the Alliance. a) They will represent their organizations in all meetings and consultations, as well as in the General Assembly, of the Alliance. b) The official representatives may duly elect or to be elected for their organization in any function of the Alliance. c) In the case that the official representative/s is unable to perform their tasks, the organization has the right to determine who would replace their official representatives. Section 2Every member organization is accorded one (1) vote each in all decision-making and elections conducted by the Alliance. Section 3The STAND – UP individual shall have voting power after one (1) year of active work in the Alliance. Section 4The STAND – UP member shall have the right to participate freely and fully in all meetings and consultations, express his/her position and opinion on particular issues, and to present his/ her criticisms and recommendations to the Alliance.
Section 5The Alliance shall have the right to elect and be elected in the leadership of the Alliance, the STAND – UP individual having served the Alliance for one (1) year, as stipulated in Section 3 of this article. Section 6The STAND – UP member shall have the right to be kept informed n all affairs of the Alliance, have the access to all records and documents of the Alliance. Section7The STAND – UP member shall have the right to due process, especially in cases and sanctions. Section 8All member organizations and individuals shall be entitled to such any other rights and privileges as may be recognized by the General Assembly.
Article VDUTOES AND RESPONSIBILITIES OF MEMBERS
Section 1The STAND – UP member shall abide and implement the policies. Decisions and programs of the Alliance. Section 2The STAND – UP member shall attend and actively participate in all regular and special meetings, conferences and assemblies of the Alliance. Section 3The STAND – UP member shall promote and protect the integrity of the Alliance. Section 4The STAND – UP member shall pay all financial obligations promptly. Section 5The STAND – UP member shall encourage all other student organizations to join the Alliance. Section 6The STAND – UP member shall develop social awareness and responsibility among the studentry by involving them in the various activities of the Alliance.
Section 7The STAND – UP member shall unite and support other organizations and sectors within and outside of the University in the protection and promotion of common rights and welfare. Section 8The STAND – UP member shall assume such other duties and responsibilities as may be mandated by the General Assembly of the Alliance.
Article VITHE GENERAL ASSEMBLY
Section 1The General Assembly (GA) shall be the highest policy-making body of the STAND – UP. Section 2The General Assembly shall have the following powers and functions: a) Study, amend, revise and ratify the constitution; b) Formulate, approve and enforce decisions, policies, resolutions and stands on issues and programs of action for the Alliance; c) Receive and review the reports of the Executive Board and Executive Council; d) Elect the officers of the Alliance;
e) Decide upon the acceptance of the membership of organizations into the Alliance after the recommendation of the Membership Committee; f) Act and decide upon all cases of expulsion of member organization and impeachment and/or removal of officers of the Alliance; g) Do such other functions and duties as it may deem necessary Section 3The General Assembly of the STAND – UP shall convene within the first thirty (30) days after the opening of classes each semester, and every second week of August for the election of officers. Section fourhe General Assembly shall convene on emergency or special sessions upon the recommendation and approval of two-thirds (2/3) of the member organizations present during the Executive Boards meet.
Article VIIITHE EXECUTIVE BOARD
Section 1The Executive Board (EB) of the STAND – UP shal act as the chief executive and/or mplementing body of the Alliance in between General Assemblies. Section 2The Executive Board shall be composed of the official reprsentatives of all member organizations, plus the Executive Council of the Alliance. Section 3The members of the Executive Board shall serve a term of one semester. Section 4The Executive Board shall have the following powers and functions: a) impelement policies, resolutions, decisions, plans or programs made by the General Assembly;
b) Formulate, decide upon and adopt such other policies, resolutions, decisions, plans and programs as it may deem necessary, until modified, charged or nullified by the General Assembly; c) Create other committees, task forces or machineries necessary in pursuit of the plans and program of the Alliance and appoint the heads thereof; d) Prepare the agenda and specific date of the General Assembly; e) Convene an emergency or special session of the General Assembly through a two-thirds (2/3) vote of all member organizations present; f) Make recommendations to the general Assembly on matters affecting the Alliance g) Receive and approve the reports of the Executive Council; h) Do other functions, as it may deem necessary.
Section 5The Executive Board shall have the special powers to appoint revisionary officers in case of vacancy in the Executive Council until the ratification of the General Assembly. Section 6The Executive Board shall meet twice a month, the specific schedule to be determined by the Executive Board in session.
Article IXTHE EXECUTIVE COUNCIL
Section 1The Executive Council (EC) of the STAND – UP shall take the care of the day-today functions of the Alliance. It shall exercise the general responsibility over all standing and other committees of the Alliance when the Vernal Assembly and/or the Executive Board is not on session. Section 2The Executive Council shall be composed of all duly elected officers of the Alliance, i.e. the Chairperson, the Secretary General, and the Committee Heads on Membership, Education, Propaganda, Finance and Basic Masses Integration. Staff members of all committees may still sit as non-voting participants of the Executive Council. Section 3The Executive Council shall have the following powers and functions: a) Formulate tee rules and regulations that will govern the administration and organization.
b) Exercise general supervision and responsibility over all committees of the Alliance. c) Draw up the generl program of action for the approval of the General Assembly. d) Ensure, monitor, direct and coordinate the plans, decisions and programs of the Alliance. e) Maintain the files and records of the Alliance. f) Make regular repots to the Rxecutive Board on the status of thr Alliance. g) Perform such other duties and functions as may be delegates by th Executive Board on the General Assembly. Section 4The Executive Council shall meet once a week.
Section 5The Executive Council shall hold special meetings whenever necessary. Section 6The members of the Executive Council shall serve for a term of one year.
Article XPOWER AND DUTIES OF OFFICERS
Section 1The Chairperson of the STAND – UP shall have the following powers, duties and functions: a) To preside over all sessions of the Executive Council, the Executive Board and the General Assembly; b) To represent and act as official spokesperson of the Alliance in all official External activities; c) To exercise general supervision and responsibility over the Alliance and ensure the functioning of all officers, committees and members of the Alliance; d) To sign all resolutions and documents of the Alliance to make them official; e) To enforce the provisions of the Constitution and all other rules and regulations which may be promulgated from time to time; f) To perform such other functions as may be delegated by the General Assembly. Section2The Secretary General of the STAND – Up shall have the following powers, duties and functions: a) To assist the Chairperson, particularly on internal matters and operations of the Alliance;
b) To act as Chairperson in the latter’s absence or incapacity; c) To keep a journal of all proceedings of the Executive Council, Executive Board and the General Assembly; d) To perform such other functions as may be delegated by the Executive Council. Section 3The Membership Officer shall assume primary responsibility over the expansion and consolidation of the Alliance. a) It shall formulate and administer membership procedure of organizations into Alliance. The procedure shall be approved by the Executive Board; b) It shall have the power of recommend to the General Assembly the membership of new organizations as stipulated in Section 2 of Article III.
Section 4The Education Officer of the STAND – UP shall assume the primary responsibility over the socio-political education and development of the analytical and leadership skills of all members of the Alliance. a) It shall formulate a curriculum every semester to be approved by the Executive Board and distributed to the members and organizations of the Alliance; b) It shall coordinate with the Education Officers of the member organizations of the Alliance. Section 5The Propaganda Officer of the STAND – UP shall assume primary responsibility over the public information and relations of the Alliance.
a) It shall administer its cultural sub-committee which shall promote pro-student, pro-people and nationalist culture utilizing creative forms in reaching out to UP community and rest of the society; b) It shall administer its publication sub-committee which shall instutionalize the monthly newsletter STAND – Update. Section 6The Finance Officer of the STAND – UP shall assume primary responsibility over the acquisition, control, utilization of the funds and logistics of the Alliance. Section 7The Basic Masses Integration Officer of the STAND – UP shall assume primary responsibility over the integration of member organizations and individuals with the basic sectors of workers and peasants.
Article XISTAND – UP CHAPTERS
Section 1The STAND – UP Chapters could be established in a particular college by the member organizations of STAND – UP. Section 2The recommendation for the formation of the Chapter shall have the approval of the Executive Board. Section 3The establishment of a chapter shall have the final approval of the General Assembly of the Alliance. Section 4The special and main responsibility of the STAND – UP Chapter in a particular college is to reach out and organize other student organizations based in the same area.
Section 1The funds of the STAND – UP shall be derived form the membership fee, the annual organizational dues, contributions, donations and other fund-raising activities. Section 2The membership fee and the annual organizational dues shall be determined by the General Assembly of the Alliance.
Article XIIIAMENDMENTS AND EFFECTIVITY
Section 1Any provision of this Constitution may be amended, altered or repealed by at least a vote of two-thirds (2/3) of all member organizations present in the General Assembly. Section2 All proposals for amendments must be submitted by any member organization in written form together with the explanations of such the Secretary General at keadt fifteen (15) days prior to the General Assembly. Section 3This Constitution shall take effect immediately after the ratification by two-thirds of all member organizations present during the Alliance Second Congress.
