The second amendment says you have the right to bear arms but that doesn’t make the government stop regulating it. The main point of this case is where to say the government has gone too far or is being far to the citizens of NYC. The case I am arguing is that they are taking it to far. To determine if they have gone to far we first need to figure out what their rules are. And the historical meaning of the Second Amendment right to bear arms.

Let’s begin with the historical meaning of the right to bear arms. The right to bear arms the second amendment means your have the right to have an arms they never clarified but we know that they have meant guns.

The second amendment was made to help protect the people from a tyrannical government. They wanted to keep the second amendment as a precautionary of the new government starts to take away their rights of course now they keep it to protect themselves in general but it still keeps the base of why it’s made, so the people can protect themselves.

NYC has many rules ‘regulating’ guns. Though what does not need to be regulated but to the point they are taking it is crossing the line. Some rules would be you have to have a license to get a gun, if you get a premises license you can’t take it away from one address unless you get permission from the law. After that you can’t just take it from one place to another and back you have to carry amo and the gun in different containers.

Why I believe is unfair by that law is that they are not only restricting your usage but if you come into contact with a real criminal you have to try and load your gun and shoot while the criminals has to only shoot then you wouldn’t be able to defend yourself.Many examples of states trying to take people’s second amendment away one way of the other but the Supreme Court votes to their favor. A recent case that shows what I mean is Caetano v. Massachusetts in 2016. What happen is that a women kept a stun gun to protect herself against her abusive ex boyfriend but because stun guns where allegal against machitpchusite state law she was arrested.The case made its way to the Supreme Court, which ruled that stun gun was and “all instruments that constitute bearable arms,” are protected under the Second Amendment.

The Supreme Court has not always been this way because in the original trials the people would lose to the state but now their perspectives change why because they are being to understand what they meant by the right to bear arms. They mean being able to take your weapon without being regulated so much that you don’t have one they mean having your basic second amendment without having so many strings attached they mean that you have the right to bear arms that you can have a weapon without feeling like you don’t have one at all. NYC is taking their rules to far and are crossing the line, I believe that they should try to minimize their rules as much as possible because currently NYC are breaking the second amendment.
