Challenging Women to the Rules of the Law

Categories: Abortion

Wade and Roe presented a petition, in the year 1973 to the Supreme Court concerning the right of women to privacy, and hence the right to abortion when necessary. The Supreme Court therefore, ruled in favor of Roe. During the first trimester of pregnancy, women have the right to privacy. This meant that women could opt for abortion in case they felt not incapable of keeping the pregnancy. Aborting the fetus during the first trimester does not endanger the life because the fetus is underdeveloped.

The second trimester is the one that brought so many issues because, at this point, the fetus is developed, and abortion endangers its life.

Some women are faced with different situations such as rape, illnesses, and domestic violence that make it hard to keep the pregnancy, hence the decision to abort during the first trimester. The period where women had the freedom until they were 20 weeks pregnant might be gone and new laws enacted, which might affect this freedom.

There are different effects that women will face when prevented from having the right to do anything with their bodies. This argumentative essay provides critiques on how women will be affected.

Discussion and Analysis

I think women's rights will change when the laws to prevent them from having abortions are enacted. Their right to privacy and the right to do what they feel is right for their bodies will be affected. Carrying the pregnancy requires strong support surrounding it. In cases where women feel they do not get enough of such support from the environment makes them feel less connected to the pregnancy.

This is why they opt to get an abortion to be happy. Women have the responsibility of ensuring that they offer the best conditions for the fetus to ensure proper development. When they feel can provide such situations to their baby, they feel the need to get rid of the fetus as early as possible. The new laws will affect these conditions for women. They will be forced to raise babies whom they have no connection to and in terms that are not safe for babies’ growth, as opposed to babies that are born at the right time and in good conditions. That is why men have joined hands to prevent women from being assault when it comes to sexual matters. They desire women to get the right to do what they feel like with their bodies (Loofbourow, 2018).

In the year the 1840s, the state had made it illegal for abortion drugs to be sold publicly. Despite the rules, drugs were sold, and women would buy them over the counter. Those who failed to abort at home would go to physicians to perform the procedure. This made abortion a common issue, and no one complained about it. Women had the freedom to decide whether to keep the pregnancy or abort it. This reduced the discrimination against the women that had abortedbeen assault and brought equality. No one was seen to be evil for aborting, as long as they had their reasons (Gerdits, 2015). Women raised children they planned for and when they were capable of providing. When the laws changed, there were more adoptions because most women were unable to support the babies. When someone is raped and impregnated, the pain of living to see such a baby never goes away. When they look at such children, they feel more pain. If they got the chance to abort, such pain might go away with time, and they get to heal as time goes (Wurth, 2019).

It is hard to be denied medication because one is pregnant. There was an incident in the United States where a woman has rejected chemotherapy with b doctors for having leukemia, in the year 2012 (Wurth, 2019). The family requested an abortion, but the doctor refused to say it was against the law. The woman died a few days later, and the family blames the doctors for not saving the life of their daughter. When the state brings back such days, most people are going to lose the chance to get medication, mostly when it comes to chemotherapy. If the state intends to enact the laws to save the lives, is it worth protecting the life of a mother or a fetus that is underdeveloped? I think a grown-up is worth saving because they have families to take care of. Imagine a situation where doctors called police officers on a lady who had a miscarriage without her knowledge that she was pregnant. There is a need for the state to allow women to exercise their rights to their bodies (Ganatra et al., 2016).

Abortion was illegal until 1973. Before the legalization, most women were forced to give up their babies for adoption because they never got a chance to abort, and they were not in a position to take care of the babies. According to the University of California (2020), it is one thing to abort a fetus. Still, it is excruciating to give up a baby because you cannot provide for him or her. In case the United States changes the right to legal abortion, people will still go for it but with caution not to be realized. Before the constitutional abortion law got enacted, in the year 1969, most women performed illegal abortions in privacy because they never wanted to raise the babies. They endangered both their lives and those of the fetus because they never had medically approved abortions. They never had a right to a medical procedure. This took away the ability to control their bodies. This is what should be expected when abortion is illegalized. The United States has reduced the funding of abortions. This is affecting the poor women who don’t get the right to access safe and legalized abortions (Assifi, Berger & Ganatra, 2016).

Conclusion

In conclusion, I think it is better if the states reconsider the idea of illegal abortions. There are some situations where women have to be considered. There is a need for the state of feeling the pain that women undergo. They cannot be forced to carry the pregnancy for nine months in distress and hardships. The law should leave the choice to the women. They need the right to privacy and to decide as to what is best for their bodies and the children they desire to carry. Most women defy the rules of the law to get rid of the pregnancies they are unable to take.
